war on Iraq in the light of the rules of international legitimacy political &lawful study to the decision of the security council(2001-2004)
Master Abstract
The subject of the study is about studying &analysing Iraq war according to international legitimacy through studying the lawful policy of the issue of the security council as it is considered the body which is responsible for keeping international peace & the security that keep peace with the laws of the united nations charter.
This study discusses the legal use of power in international relations that can be applied to Iraq case ( 1990&2003) through concentrating on the decisions issued by the security council during the second Gulf war & during the war on Iraq( 2003)
To indicate the difference in the lawful adaptability for these two crises, besides handling the period that followed Iraq war through reviewing the most important discussions taken by the security council during that period to indicate the work of the council & the responsibility of the occupation forces with in the limits of the law of war occupation in this period .
This study aims at answering the main question about it . This question in about the agreement between the discussion of the security council & rules of international legitimacy .
This study comes from the changes that the world witnesses now & the most distinguished one in the international unity against terrorism through the " compaigne against terrorism "which is headed by the U.S.A& it's aliens, besides what will happen due to interfering in the other countries affairs & the severe & illegal useof military force in the international relations under the protext of struggling against terrorism in aform that evoke confussion in the international society , in addition to violating the issues & the rules of the international law which organize of the whole world .
This study is divided into four chapters: the Ist chapter concentrates on the rules that control using military force in the international relations. The 2nd chapter deals with the decisions of the security council concerning Iraq war (2003). The 3rd chapter discusses the situation of security council concerning Iraq war (2003). The 4 th chapter deals with the role of the council after the war .
-This study has provided that using force against Iraq 1991 takes place according to the rules of international law as it is areaction against clear violation to the rules which have been assured by the charter of united nations concerning the relations among nations & respecting their rights & domination & this way ignored on the part of Iraqi system on it's aggression & occupying Kuwaiti land .
-Using force against Iraq in 2003 war illegal work & it doesn't depend on lawful back around . This study also shows that the American forces are not adhered to the laws of protecting the environment because the armed disbutes * restricting the rights of the fighters & distinguishing between civil & military aims . Besides analysing the behavior of security council towards the Iraq crises expresses the reality of argumentative relation between force & legality .
